ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.11.2019 in connection with Excise Case No.392 of 2019 arising out of Barbigha P. S. Case No.243 of 2019 registered for the offence under Sections 30(a), 30(d) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from his conscious possession; but from an abandoned house. It is further submitted that petitioner is having only one antecedent, in which he has already been granted bail.

In view of the aforementioned facts and

No.79391 of 2019(2) dt.04-12-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Sheikhpura in connection with Excise Case No.392 of 2019 arising out of Barbigha P. S. Case No.243 of 2019.
