The petitioners seek bail in a case instituted for the offences under Sections 366(A) and 34 of the Indian Penal Code.

The prosecution case in short is that the accused persons forcibly abducted the daughter of the informant for the purpose of marriage.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 14.10.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have

Patna High Court CR. MISC. No.79426 of 2019(2) dt.04-12-2019 2/2 falsely been implicated in the present case. On recovery, the statement of the victim has been recorded under Section 164 Cr.P.C. in which there is no allegation of physical or sexual assault against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
