2. The petitioner seeks bail in connection with Narkatiyaganj P.S. Case No. 34 of 2022 registered for the offence under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, it is alleged that the dead body of the deceased was recovered from the railway track.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 16.03.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Railway, Bettiah, West Champaran in connection with Narkatiyaganj P.S. Case No. 34 of 2022 on the following conditions:- a). One of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide.

b). The petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself. c). The petitioner shall shall mark his attendance at Bagaha(Patkhauli) Police Station on first Sunday of each month.

d). The petitioner shall, in no way try to induce or promise or threat the witnesses or tamper with the evidences,

The petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds of the petitioner.
