The petitioner is seeking anticipatory bail in connection with Trial No. 2204/2001 of 2019 arising out of Kochaikote P.S. Case No. 191/2018 registered under Sections 30(a)(b)(c) of Bihar Prohibition act, 2016, pending in the Court of learned A.D.J. - 2 - cum - Special Judge, Excise, Gopalganj. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case as he is the owner of the vehicle, however he has no criminal history. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances of the case wherein this petitioner is said to be the owner of the truck on
Patna High Court CR. MISC. No.80307 of 2019(2) dt.06-12-2019 2/2 which 1900.800 liters of illicit liquors were being transported, there being allegation that petitioner being owner of the truck was involved in trading of illicit liquor, this Court is not inclined to grant him privilege of anticipatory bail.
Prayer for anticipatory bail of the petitioner is refused. In case, petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on it's own merit without being prejudiced by the order of this court.
