2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
3. It is alleged that on 17.8.2023 while the informant was going by his motorcycle, meanwhile, some unknown miscreants intercepted him and snatched his motorcycle bearing Reg. No. BR05AC-7092 and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Petitioner is not named in the FIR. During course of investigation, his name came into light on the basis of disclosure of spy. Neither
Patna High Court CR. MISC. No.2348 of 2024(2) dt.30-01-2024 2/2 the petitioner is put on TI Parade nor any incriminating article has been recovered from his conscious possession. It is further submitted that the petitioner is languishing in judicial custody since 28.9.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Motihari Muffasil P.S. Case No. 605 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari.
