JUSTICE SANDEEP KUMAR ORAL ORDER 19-03-2024 This is an application for direction to the respondent authorities to initiate a proper proceeding for removal of encroachment made over the public land and further conclude the same as the petition for removal of encroachment is pending since 2020 before the Circle Officer, Shahpur.

2. The Circle Officer, Shahpur, Bhojpur(respondent no. 5) is directed to act upon the representation dated 30.10.2023 filed by the petitioner and if the Circle Officer, Shahpur finds any encroachment then he will issue notice to the alleged encroachers and, thereafter, conclude the proceeding

3. If any of the alleged encroacher(s) raises objection with regard to the measurement, the measurement shall be done in presence of the alleged encroacher(s).

4. Accordingly, this application is disposed of.

5. Disposal of this application shall not mean a direction to the Circle Officer, Shahpur to remove the alleged encroachers without any proceedings.

6. If any proceeding is initiated, the same shall be concluded within six months of its initiation. (Sandeep Kumar, J) Shishir/- U
