1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. Learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no.2, namely, Nitish Kumar @ Nitesh Kumar, who was arrested during pendency of the instant anticipatory bail application.
3. Permission is accorded.
4. The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.86211 of 2025(2) dt.20-01-2026 2/3 registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of the B.N.S., 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no.4 and 5 are women and the informant alleges that on 16.07.2025 it was raining heavily as such water started entering his house, hence the informant started constructing mud bandh for stopping the water entering his house, when accused persons including the petitioners came variously armed and threatened, on protest by informant, Ashik gave order to kill, on which Nitish assaulted him by an iron rod causing injury on head, while Ashok assaulted Santosh by rod causing injury on head, thereafter Niraj assaulted Uday by an iron sariya causing injury on head, while Priyanka and Manti Devi dashed Binita on the ground and Himanshu assaulted Bulbul Devi by lathi.
6. Learned counsel submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that on account of dispute relating to entering of water in the house, an altercation took place, in which both side assaulted each other. It is next submitted that from perusal of Annexure-2 series, it would manifest that the injury suffered by the injured has been opined to be simple in nature and the entire
Patna High Court CR. MISC. No.86211 of 2025(2) dt.20-01-2026 3/3 family members have been implicated. It is also submitted that petitioners are not criminals.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No.100/2025, corresponding to G.R. No.2065 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
