This present application has been filed for transfer of Divorce Case No. 163 of 2018 from Principal Judge, Family Court, Nalanda at Biharsharif to the Principal Judge, Family Court, Gaya.

It has been submitted by the learned counsel for the petitioner that the marriage of the petitioner was solemnized on 22.04.2016 at Village- Kehauda, Police Station- Tekari, District. Gaya as per Hindu rites and rituals. It is further submitted that the opposite party and his family members started demanding money from the parents of the petitioner. On one or two occasions, the parents of the petitioner fulfilled the demand of dowry to the opposite party. But as it is not possible for anyone to fulfill the indefinite demand of dowry, the parents of the petitioner failed to fulfill the demand of dowry to the opposite

On account of non-fulfillment of demand of dowry, the opposite party started torturing the petitioner and on 29.06.2017 the opposite party and his family members took away all the jewelries of the petitioner and ousted her from in- laws house. Petitioner being an unemployed lady and having a son, and she has no source of income and to meet the daily expenses, the petitioner has to take help of her parents. Considering the difficult being faced by the petitioner in travelling to Nalanda at Biharsharif to contest her case, this application for transfer is allowed. Divorce Case No. 163 of 2018 pending in the Court of the Principal Judge, Family Court, Nalanda at Biharsharif to be transferred to the Principal Judge, Family Court, Gaya. The parties shall appear in the Court of the Principal Judge, Family Court, Gaya and thereafter the proceeding will be conducted in the Court of the Principal Judge, Family Court, Gaya.

Let a copy of this judgment be communicated to the Principal Judge, Family Court, Nalanda at Biharsharif as well as to the Principal Judge, Family Court, Gaya for its compliance. (Sandeep Kumar, J) Shishir/- U
