JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 The petitioners apprehend their arrest in connection with Silao P.S.Case No. 224 of 2018 registered under Sections 25(1AA), 25(1-B)a/26/35 of the Arms Act. Allegation as per the FIR is that police received information that Manoj Kumar who was engaged in arms business as such police raided his house and recovered country made pistol, cartridges and cash of Rs. 5,10,200/- and he disclosed the names of these petitioners indulged in arms dealing. It further appears that petitioner no. 1 is accused in two cases and petitioner no. 2 is accused in three cases of similar nature, except one case.

Submission of learned counsel for the petitioners is that nothing has been recovered from their possession and they have been named on confessional statement of co-accused.

Having heard both sides and in view of the allegation as well as criminal antecedents of the petitioners I am not inclined to grant privilege of anticipatory bail to him rather they should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
