The petitioners have prayed for bail in connection with Lalganj P.S. Case No. 376 of 2019 registered for the offence punishable under section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, illicit liquor was recovered from the motorcycle. Both the petitioners is said to have been riding on one motorcycle from which 50 litres of country made liquor was recovered.

It is submitted by learned counsel for the petitioners that no recovery of illicit liquor has taken place, the petitioners

Patna High Court CR. MISC. No.80068 of 2019(2) dt.05-12-2019 2/2 are in custody since 22.10.2019 and investigation has concluded, charge-sheet has been submitted and they have no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 376 of 2019.
