Grievance of the petitioner in the present writ application is non payment of arrears of difference of enhanced salary.

Learned counsel for the petitioner submits that the petitioner has been granted IIIrd ACP but the actual monetary benefit has not been provided to the petitioner. The petitioner has superannuated 31.1.2011.

Learned counsel submits that in terms of ACP Rules he was entitled to monetary benefit with effect from 1.1.2009.

Patna High Court CWJC No.25406 of 2019(2) dt.19-12-2019 2/2 Considering the fact that petitioner has superannuated in 2011, instead of keeping the matter pending, the writ petition is disposed of with a direction to the respondent no.2, District Magistrate, Nalanda at Biharsharif to verify the record and if it is found that the petitioner was granted ACP, the monetary benefit must be provided to the petitioner, if not already provided within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
