====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Mojahidpur P.S. Case No. 152 of 2018, instituted for the offence under Section 366(A)/34 of the Indian Penal Code.

It is alleged in the written report that daughter of the informant has not returned from coaching. The informant during search got knowledge that this petitioner has kidnapped her.

The victim girl on recovery has given statement under Section 164 Cr. P.C. which finds mentioned in the impugned order wherein she has stated that she had gone with this petitioner to Banka out of her own free will and stayed

Patna High Court Cr.Misc. No.2640 of 2019(3) dt.07-02-2019 2/2 with him in rented house for about 25 days.

Petitioner is in custody since 22.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur P.S.
