Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code and Section 3/4 of D.P.Act.

Though allegation in the FIR is that the petitioner committed dowry death of his wife, however, the statement of the five witnesses examined during trial including the informant, who is father of the deceased, would reveal that they have not supported the prosecution allegation in their cross examination.

Hence, let the petitioner, above named, who is

Patna High Court CR. MISC. No.79053 of 2018(4) dt.15-04-2019 2/2 in custody since 15.10.2018, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.62 of 2019 arising out of Shakurabad Police Station Case No.33 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
