No. 44 of 2018 dated 08.06.2018 registered at Police Station Karamchat District-Kaimur (Bhabua) under Sections 201 and 302/34 of the Indian Penal Code.

Petitioner is in custody since 18.06.2018.

It is the case of the prosecution that the accused assaulted the deceased and thereafter killed her and set her body on fire. None from the family of the deceased were informed of cremation, alleged to have been carried out by the petitioner/bail applicant, after the death of the deceased in any natural circumstances.

The case made out by the prosecution is serious. Investigation has revealed complicity of the accused in the

Patna High Court CR. MISC. No.79641 of 2019(3) dt.11-12-2019 2/2 crime. Charge stands filed and trial is in progress. It is seen that even on earlier occasion, this Court has rejected the petitioner's request for grant of bail. This was order dated 05.12.2018 passed in Cr. Misc. No. 67479 of 2018 (Amrit Kumar @ Amrit Singh vs. The State of Bihar).

No doubt, petitioner is suffering incarceration since 18.06.2018 but then there is no change in circumstances warranting this Court to grant the privilege of bail to the petitioner.
