JUSTICE RAJESH KUMAR VERMA ORAL ORDER 03-04-2024 Heard Mr. N.K Agrawal, learned senior counsel for the petitioner, Mr. Dinesh Jha, learned counsel appearing on behalf of the informant as well as Mr. Anant Kumar 1, learned Additional Public Prosecutor for the State.

2. Petitioner seeks bail who is in custody since 05.01.2021 in connection with Belsand P.S. Case No. 02 of 2021, F.I.R. dated 03.01.2021 for the offences punishable under Sections 341, 323, 302, 201, 120B, 504, 506/34 of the Indian Penal Code.

3. Earlier the anticipatory bail application of the petitioner has been rejected by this Hon'ble Court vide order dated 26.06.2023 passed in Cr. Misc. No. 8726 of 2023.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been

5. Vide order dated 09.02.2024 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 15.02.2024 reveals that out of 9 witnesses, 8 witnesses have already been examined and only I.O. is remained to be examined.

6. The learned counsel appearing on behalf of the informant submits that on 28.03.2024 the I.O. has also been examined.

7. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail of the petitioner.

8. In view of the report of the learned Trial Court and the submissions made by the parties, I am not inclined to enlarge the petitioner on bail in connection with Belsand P.S. Case No. 02 of 2021 pending in the court of learned 1st Additional Sessions Judge, Sitamarhi.

9. Prayer is refused.

10. However, learned Trial Court is directed to expedite and conclude the trial at the earliest. (Rajesh Kumar Verma, J) Vanisha/- U T
