This application for anticipatory bail arises out of Complaint Case No. 3513 (C) of 2018 in which cognizance has been taken under Sections 498-A and 406 of the Indian Penal Code.
It has been submitted by learned counsel for the petitioner that the parties have mutually filed divorce application and the divorce has been granted by the Principal Judge, Family Court, Patna, vide his order dated 26.10.2021. Paragraph no. 5 (iv) of the Matrimonial Application filed by the parties for grant of divorce with mutual consent reads as follows:-
Patna High Court CR. MISC. No.270 of 2020(5) dt.05-04-2022 2/2 "That by taking appropriate action in Complaint Case No. 3513(C) of 2018, pending in the Court of Learned Chief Judicial Magistrate, Patna the parties by taking joint efforts shall get the said case disposed off without any adverse order against the first petitioner and his parents before disposal of the present case. "
Since both the parties have mutually agreed that all the litigations between them should come to an end, the entire proceeding of Complaint case No. 3513 (C) of 2018 pending in the Court of learned Chief Judicial Magistrate, Patna or the transferee Magistrate is hereby quashed.
