2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 338, 336(3), 340(2), 318(4) and 3(5) of the BNS.

3. The case of the prosecution in short is that the informant has information that fraudulent certificates were being made. On this information, informant along with his associates entered in a shop in name and style of U.S. Enterprises where two persons were working. They started fleeing away and one was apprehended and was identified as the petitioner. On being asked the petitioner told that Brajesh Kumar Tiwary who has managed to flee away is the owner of U.S. Enterprises. It is further stated that they were preparing forged documents. It is further alleged that from the said enterprises, Scanner, CCTV camera, fingerprint scanning

Patna High Court CR. MISC. No.85066 of 2025(2) dt.16-12-2025 2/2 machine, USB cable, laptop etc. were recovered.

4. Learned counsel for the petitioner has submitted that the said enterprise is owned by co-accused Brajesh Kumar Yadav and the petitioner is only a worker. The said shop is a photocopier shop and it has been submitted that nothing has been recovered from the possession of this petitioner. Learned counsel for the petitioner has further submitted that the petitioner is a man of clean antecedent and is in judicial custody since 26.09.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the bail of the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Garkha P.S. Case No. 717 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sarat at Chapra.
