JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 This application, for grant of anticipatory bail, arises out of Barhara P.S. Case No. 239 of 2018, disclosing offences under Sections 406, 409 and 34 of the Indian Penal Code. Allegation is of misappropriation of the Govt. money meant for construction of Toilets under Nirmal Bharat Abhiyan Scheme.
Submission of learned counsel for the petitioner is that she has falsely been implicated in this case and the construction was to be made through the Women Milk Production Cooperative Society, Phuhan, of which, co-accused Gayatri Devi is the Secretary and she has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 08.10.2018 passed in Cr. Misc. No. 45198 of 2018 and being Mukhiya, the petitioner's role was
Patna High Court CR. MISC. No.2143 of 2019(4) dt.17-04-2019 2/2 limited in the scheme as she only had to verify as to whether the work has been done or not and by forging her signature, the report has been submitted.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Barhara P.S.
