The petitioners seek anticipatory bail in connection with Complaint Case No. C-346 of 2018, registered for offences punishable under Sections 498 (A) of the Indian Penal Code. The allegation against the petitioner as per F.I.R. is that the petitioner, who happens to be the husband of the complainant is of subjecting her to torture due to non fulfillment of demand of Rs five lacs and one four wheeler. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and there is general and omnibus allegation has been attributed
Patna High Court Cr.Misc. No.2820 of 2019(3) dt.21-02-2019 2/2 against the petitioner and the petitioner has no criminal antecedent.
Heard learned A.P.P. as well as learned counsel for the informant and perused the impugned order which discloses that still she is not ready to live with the petitioner. Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named,surrender before the court below within a period of six weeks from today and on surrender he shall be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Kishanganj in connection with Complaint Case No. C-346 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr. P. C. with further condition that if in future, if the complainant file a maintenance case, the petitioner shall have to appear and cooperate in disposal of the case.
