An allegation has been attributed against the petitioner by the informant, an ANM that while she was engaged in vaccination, the petitioner came and insisted her to come to his house for vaccination and for that used force. On her protest, abused and further threatened of dire consequences. It has further been disclosed that at that very time smell of wine was coming from his mouth.

Right from the written report there happens to be consistency that the petitioner had insisted to come to his house for vaccination. There happens to be specific disclosure at her end that at that very time she was engaged in vaccination but, when the place of occurrence has been gone through as

Patna High Court CR. MISC. No.80913 of 2019(3) dt.01-07-2020 2/2 enumerated in para 5 of the case diary, it is evident that the same happens to be an imaginary one rather the same was not shown by the informant and for that the I/O had recorded behind back of Baithka of local Mukhiya.

In the aforesaid facts and circumstances of the case, petitioner, Munna Kumar @ Munna in the event of his arrest or surrender within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya (Banjaria) P.S. Case No.95 of 2019 (G.R. No.1004 of 2019) in terms of the conditions so laid down under Section 438(2) of the Code of Criminal Procedure.
