====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 10-12-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Maheshkhunt P.S. Case No. 115 of 2019, G.R. No. 2749 of 2019 for the offence registered under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the entire allegation is false and frivolous and has been occasioned only because there was a dispute with regard to the purchase of

Patna High Court CR. MISC. No.80850 of 2019(2) dt.10-12-2019 2/2 land made by the wife of the Petitioner No. 1. It is further submitted that the claim being made by the informant and one Rajan Singh is false and frivolous and admittedly no person has been injured in the alleged act of firing as has been alleged in the FIR.

Considering the aforementioned facts and circumstances and the petitioners have a clean antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate Ist Class, Khagaria, in connection with Maheshkunt P.S. Case No. 115 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
