JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the C.B.I. The petitioner apprehends his arrest in connection with R.C. No. 8A of 2014, registered under Sections 420, 468 and 471 of the Indian Penal Code and Sections 13(ii) read with Sections 13(i)(d) of the Prevention of Corruption Act, 1988, pending in the Court of Special Judge, CBI-II, Patna. The prayer for anticipatory bail of the petitioner was rejected earlier on 18.07.2017 by this Court vide Criminal Miscellaneous No. 2459 of 2017 on merit.

Learned counsel appearing on behalf of the petitioners submits that, in fact, petitioner was deputed to verify the certificates of 10 candidates and out of them, certificate of only

Patna High Court CR. MISC. No.5692 of 2019(5) dt.01-05-2019 2/2 one candidate was found forged and certificates of remaining candidates were found genuine and this fact was not brought on record on rejecting the bail prayer of the petitioner on 18.07.2017.

Since, the prayer for pre-arrest bail of the petitioner was rejected earlier, on merit, I find no fresh ground to reconsider the prayer of the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is, again, rejected (Rajendra Kumar Mishra, J) manish/- U T
