The instance application for regular bail has been filed by the petitioner in connection with Madhepura Parmanandpur O.P. P.S. Case No. 456 of 2022 instituted for the offence under Sections 302, 341, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act. Earlier, the application for regular bail of the petitioner was rejected by order dated 24.07.2023 passed in Cr. Misc. No. 26994 of 2023.
In pursuance to the direction of the Court, a Report with regard to present stage of trial has been received on 19.01.2024 from which it appears that, case is pending for
Patna High Court CR. MISC. No.2155 of 2024(3) dt.09-02-2024 2/2 prosecution evidence. Out of nine charge sheeted witnesses, three prosecution witnesses have been examined till now and summons to the prosecution witnesses have been issued in this case.
No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.
The bail application stands disposed of.
However, learned trial Court is directed to expedite and conclude the trial within a period of nine months, failing which the petitioner may renew his prayer for bail application. (Sunil Kumar Panwar, J) Manishkr/- U T
