JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2026 At the outset, learned counsel for the petitioners seeks permission to make correction in father's name of petitioner no. 2 as 'Shiv Nath Yadav' which has wrongly been mentioned as 'Suraj Narayan Yadav'.

3. Heard learned counsel for the petitioners and the State.
4. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 189(4), 126(2), 115(2), 109, 117(2), 352, 351(2) of the Bharatiya Nyaya Sanhita.
5. As per prosecution case, on 2.8.2024 at about 11
Patna High Court CR. MISC. No.85946 of 2025(2) dt.07-01-2026 2/3 AM, all the F.I.R. named accused persons, including these petitioners assaulted informant and others by means of farsa, iron rod etc.
6. Learned counsel for the petitioners submits that due to dispute with regard to fishing, scuffle took place between the parties in which both sides sustained injuries. Case and counter case. After investigation, police submitted final form against these petitioners. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. Petitioners claim clean antecedent.
7. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jhanjharpur, Madhubani in connection with Rudrapur P. S. Case No. 84 of 2024, subject to condition as
