JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 Petitioners seek bail in anticipation of their arrest in connection with Lakhisarai P.S.Case No. 461 of 2017 registered for the offences under Sections 302, 34, 120B of the IPC and Section 27 of the Arms Act.
Allegation against the petitioners is that informant has suspected the hands of the petitioners in killing of his father. Submission of learned counsel for the petitioners is that they have falsely been implicated and there is land dispute between the parties and there is absolutely nothing against them except they were threatening the father of informant earlier of dire consequence.
Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioners.

No.4860 of 2019(3) dt.12-03-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioners, above named, be released on provisional till the submission of charge sheet in the event of surrender in the court below within a period of six weeks from the receipt of this order, on furnishing bail bonds of Rs 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 461 of 2017. Once charge sheet has been submitted and incriminating material has come against them they have to surrender and make prayer for regular bail, which shall be considered on the basis of materials available on record.
