2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 274, 275 of the Bharatiya Nyaya Sanhita and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 845 liters spirit liquor was recovered from village Kaijalpur Nut Toli.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. He has been made accused on the basis of confessional statement of co-accused. Recovery has been made from an open place, accessible to all.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that petitioner has got three criminal

6. Considering the huge quantity of recovery and criminal antecedents of similar nature, prayer for anticipatory bail of the petitioner is refused.
