2. The petitioner apprehends his arrest in a complaint case punishable for the offence under Sections 406, 420 of the Indian Penal Code and Section 138 of the N.I.Act.
3. As per prosecution case, petitioner was working as agent in DTDC courier company and it is alleged that he misappropriated Rs. 16,25,000/- of complainant's courier company and on demand, he issued four cheques in favour of the complainant, which got dishonored due to insufficiency of fund.

4. Learned counsel for the petitioner submits that for the same cause of action, the complainant has earlier lodged an F.I.R., vide Barsoi P.S. Case No. 278 of 2022, in which petitioner has already been granted anticipatory bail by the Court below itself.

However, learned counsel for complainant / opposite party no. 2 vehemently opposes the prayer for anticipatory bail and submits that there is specific and direct accusation that the petitioner, who was working as an agent of the courier company, misappropriated huge amount of company and thereafter, he issued four cheques, which got bounced due to insufficiency of fund.
6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
