====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-02-2024 Heard Mr. Diwakar, learned counsel appearing on behalf of the petitioner and Mr. Rajesh Kumar, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Ara Mufassil (Dhobahan O.P.) P.S. Case No. 88 of 2022 dated 16.03.2022 registered for the offence punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioner, who is the son of the informant had allegedly assaulted the informant, who is his mother and his father.
4. Learned counsel appearing on behalf of the petitioner submitted that petitioner has now realised that he
Patna High Court CR. MISC. No.6624 of 2024(2) dt.17-02-2024 2/3 should not misbehave with his parent, however, no injury has been caused to the informant, who is his mother and his father. Petitioner has clean antecedent. On these grounds, petitioner seeks to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submission made on behalf of the parties, as well as, the fact that the petitioner has now realised that he should not have misbehave with his parent, which has orally been informed by learned counsel for the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7th, Bhojpur at Ara in connection with Ara Mufassil (Dhobahan O.P.) P.S. Case No. 88of 2022 dt.16.03.2022, subject to the condition that petitioner must file an affidavit before the learned District Court swearing therein that in future, he will not indulge in such criminal activities and will show respect to his parents and elderly people and other condition as laid down under Section 438(2) of the
Patna High Court CR. MISC. No.6624 of 2024(2) dt.17-02-2024 3/3 Cr.P.C.
7. The Court below is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application.
