2. The petitioner seeks regular bail in connection with Runnisaidpur P.S. Case No.429 of 2023 lodged under Sections 363, 366A/34 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against seven named accused persons including the petitioner against whom there is allegation that the accused persons have kidnapped the daughter of the informant and he has apprehension that they may kill the daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits

Patna High Court CR. MISC. No.7144 of 2024(3) dt.09-04-2024 2/3 that the alleged victim has been recovered and her statement under section 164 of the Cr.P.C. was taken place and on previous occasion, case diary and statement under section 164 of Cr.P.C. have been called for.

5. Counsel for the petitioner submits that petitioner is in custody since 05.09.2023 having one criminal antecedent in which he is on bail.

Learned counsel for the State opposes the prayer for bail and submits that upon perusal of statement under section 164 of the Cr.P.C., it transpires that the dispute between the family of the informant and the family of the Mukhiya took place due to which the petitioner along with others have forcefully created a situation due to which victim went to Mumbai, subsequently, when the accused persons received information that a criminal case has been filed, then they brought the victim to the police station for her statement.

7. Counsel further submits that it has categorically stated that nobody has misbehaved with the victim.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, but 2 months after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees
