JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kuchaikot P.S. Case No. 267of 2018 registered for the offence punishable under Sections 30(a)(b) (c), 38, 41(a) (b) of Bihar Prohibition and Excise Act, 2016. Fifty litres of liquor was allegedly recovered from the vehicle of which co-accused Pradeep Kumar was driver and was apprehended on the spot and he has already been allowed bail by a coordinate Bench of this Court. Petitioner is owner of the said vehicle and he has got no criminal antecedent. Considering the aforesaid materials, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of
Patna High Court Cr.Misc. No.79394 of 2018(2) dt.22-01-2019 2/2 receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Second Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Kuchaikot P.S. Case No. 267of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
