====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-02-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks for bail in a case registered for the offences punishable u/s 447, 341, 323, 325, 307, 379, 504, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons including the petitioner came at the informant's house and started abusing. On protest, the accused persons started assaulting the father of informant by means of lathi and brickbat as a result of which he became severely injured and during course of treatment, he died.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. He has falsely

The allegation levelled against the petitioner is totally false and based on concocted facts. Nothing specific has been attributed against him. In fact, the altercation took place between the parties over the petty issue that the puppy of the petitioner had entered the house of the informant. There is case and counter case between the parties. Similarly situated co-accused has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 08.07.2021 passed in Cr. Misc. No. 17375 of 2021. Learned counsel further submits that petitioner has no criminal antecedent and he has been languishing in jail since 29.08.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case as well as the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Punpun P.S.
