The petitioners apprehend their arrest in connection with Chhatapur P.S. Case no. 23 of 2018, registered under Section 147, 148, 149, 341, 323, 342, 379, 354, 504, 506 and 509 of the Indian Penal Code.

The accusation is that 13 persons named in the F.I.R., including the petitioners, caught hold the informant Md. Mustkim Safi and carried him near the canal and caused assault to him. On hearing the cry of the informant, some people started to raise alarm then he was taken in the house of Jalauddin, where he was robed and he was assaulted by means of fist, slaps and fatta. On the seeing the occurrence, some people informed his wife, who rushed to save him then

No.79190 of 2018(4) dt.02-05-2019 2/2 Jallauddin and Jakir Safi assaulted to the wife of informant and laid her on the ground and at that time, petitioner No.1 snatched golden chain from the wife of the informant and Rs. 280/- was also snatched from the pocket of the informant. Learned counsel for the petitioners submits that petitioners and informant are next door neighbour and due to some grudge, the present case has been lodged with false allegation after five days of the occurrence. Moreover, the injuries found on the person of the informant are of simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IV, Supaul in connection with Chhatapur P.S. Case No. 23 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
