The petitioners are apprehending their arrest in connection with Bachhwara P.S.Case no.71 of 2018 dated 14.4.2018 , registered for offences punishable under Sections 341, 323, 324, 325, 307, 379, 504, 34 of the Indian Penal Code. At the very outset it is submitted that in spite of direction of no coercive steps, vide order dated 11.1.2019, the petitioner has been arrested as the order has not been communicated, however, and considering the above fact, the learned Magistrate has granted provisional bail to the petitioner till final order is passed by this Court.
Allegation against the petitioner is of assault to the informant.
Patna High Court Cr.Misc. No.229 of 2019(3) dt.01-02-2019 2/2 Submission of the learned counsel for the petitioners is that the injuries are simple in nature, which will appear from Annexure 2.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VI, Begusarai in connection with Bachhawara P.S.Case No.71 of 2018 dated 14.4.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
