JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-08-2019 At the outset, learned counsel for the petitioner seeks permission to withdraw this writ application with liberty to prefer an appeal under Rule 32 of the Bihar Targeted PDS (Control) Order, 2016 within a period of 30 days from today. Learned counsel for the State has no objection to the same.
In the given facts and circumstances of the case, this writ application is being disposed off with liberty to the petitioner to avail his remedy under Rule 32 of the Control Order, 2016 by filing an appeal within 30 days from today. In case such an appeal is preferred within the prescribed period,
Patna High Court CWJC No.520 of 2019(2) dt.14-08-2019 2/2 the same will be considered by the Collector on its own merit and in case a question of limitation arises for consideration the same will be considered keeping in mind that the petitioner was pursuing his remedy before this Court.
