====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 308(5), and 3(5) of the B.N.S., 2023, and Section 27 of the Arms Act.
3. As per the prosecution case, the informant alleged that on 19.05.2025 at about 07:40 P.M., he received information that three accused persons had fired gunshots at his brother. Upon reaching the spot, he found his brother lying on the ground with blood oozing from his body. He was subsequently declared dead.
4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner
Patna High Court CR. MISC. No.85215 of 2025(2) dt.09-12-2025 2/2 transpired during the course of investigation on the basis of the confessional statement of co-accused Manish Kumar @ Vicky Kumar. The petitioner is alleged to be only a conspirator, and there is no allegation that he participated in the actual commission of the alleged offence. The petitioner is in custody since 05.06.2025, and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Patna City, in connection with Khajekala P.S.
