Petitioner seeks bail in Parsa Bazar P.S. Case No. 209 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.
Allegation against the petitioner is of snatching mobiles, clothes, Rs. 6000/- and ATM card on the strength of pistol alongwith two unknown accused persons and boarding off the Informant on lonely place near Punpun Ghat. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 20.07.2018.
Considering the fact that petitioner is the Tempo driver in which the occurrence has taken place and further fact
Patna High Court Cr.Misc. No.78737 of 2018(4) dt.05-02-2019 2/2 that the petitioner did not inform about the occurrence to the police and looted articles were also recovered from his possession, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
However, it is observed that petitioner may renew his prayer for bail after completing one year of jail custody. (S. Kumar, J) ranjan/- U
