JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-12-2019 This writ application has been filed seeking direction to remove illegal encroachments in the form of shops and stalls over a piece of land, which, according to the petitioner, is a public passage to the adjacent land. The encroachment has been allegedly caused by respondent No. 6.

Learned counsel appearing on behalf of the petitioner has drawn my attention to Annexure-7 of the writ application, which is a notice issued by the Circle Officer, Alauli, to the respondent No. 6, whereby he has been asked to remove the encroachment by 09.09.2019.

Patna High Court CWJC No.24155 of 2019(2) dt.05-12-2019 2/2 It has been argued that despite the said notice, the respondents are not proceeding for removal of encroachment from public land in accordance with the provisions under the Bihar Public Land Encroachment Act, 1956.

Considering the facts and circumstances of the case, this application is disposed of with a direction to the Circle Officer, Alauli, to conclude the Encroachment Case No. 10(A) of 2018-19 within two months from the date of receipt/production of a copy of this order.
