This is the second attempt of the petitioner for grant of anticipatory bail in connection with Atri P.S. Case No.80 of 2023 dated 12.03.2022, registered for the offence punishable u/s 302/201 of the IPC, pending in the Court of learned A.C.J.M. XIII, Gaya.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.4067 of 2024(2) dt.19-01-2024 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that two co-accused have been granted anticipatory bail by a co-ordinate Bench of this Court.
