The petitioner seeks pre-arrest bail in connection with Parsa Bazar P.S. Case No. 261 of 2019, registered under Sections 341, 323, 307, 504, 427, 436 and 34 of the Indian Penal Code and 25(1-b)a, 26, 27 and 35 of the Arms Act. The accusation is that in the morning of 11.08.2019, informant, Ratan Sao, came at his door, at that time, Guddu Kumar Ram (petitioner) started to make firing through pistol and remaining five accused named in the first information report and 10 to 12 unknown started to cause assault. In that course, Munna Ram gave a khanti blow at his head causing blood oozing injury, then, he fell down when Santosh, brother of the informant came, then, he was also assaulted by Jag Narain Ram

Patna High Court CR. MISC. No.82330 of 2019(2) dt.12-12-2019 2/2 through lathi. The cause of occurrence is land dispute. Submission is that while the allegation has been made against the petitioner to open fire, but, none has sustained fire arm injury. The petitioner has no criminal antecedent. Further, submission is that co-accused, Munna Ram, has already been granted the privilege of pre-arrest bail in Cr. Misc. No. 75301 of 2019 on 26.11.2019, by a coordinate Bench of this Court. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Parsa Bazar P.S. Case No. 261 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge VIII-cum-Additional Chief Judicial Magistrate, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
