2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 85 , 80 and 34 of BNS 2023 .
3 . It is a case of dowry death . The informant namely , Mita Paswan alleged that his daughter Rani Devi was married to Chotu Paswan on 21.09.2024 and after marriage , she went to her matrimonial house where these petitioners along with others continuously harassed her for dowry and demanded Rs. 3 lakhs to open a shop and also threatened her to kill. It is
Patna High Court CR. MISC. No.2053 of 2025(2) dt.17-03-2025 2/3 further alleged that on 25.09.2024 , all the accused persons along with other co-accused persons killed daughter of informant by strangulation .
4. Learned counsel for the petitioners submitted that petitioner No. 1 is father-in-law and Petitioner No. 2 is motherin-law and petitioner No. 3 is brother-in -law of the deceased. The are simply victims of over implication . It is further submitted that no any antemortem injury was found on the person of the deceased except ligature mark on neck and doctor has opined the cause of death of Rani Devi due to Asphyxia caused by hanging. They are separate in mess and property and they have no concern with the affairs of the couple . It is further orally submitted that thrust of accusation is against the husband of the deceased who is already in custody . Petitioners claim clean antecedent.
5 . Learned counsel for the State opposes the bail petition .
6. Considering the aforesaid facts and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.2053 of 2025(2) dt.17-03-2025 3/3 satisfaction of the learned ACJM VI Patna City Patna in connection with Gaurichak P . S. Case No . 543 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the BNSS 2023 .
