The grievance of the petitioner is that he along with others had applied for the post of Anganbari Sevika for Ward No. 7 of Village- Belahiya, Gram Panchayat Raghunathpur, Block-Ramgarhwa, District-East Champaran, the name of the petitioner was shown at serial no.1 in the merit list prepared on 04.10.2018 (Annexure 2 to the writ petition) but in spite of that petitioner was not selected on the said post. While she had given an application before the District Programme Officer, East Champaran (respondent no.3) and also before the

According to Clause -XII of the guidelines regarding selection of Anganbari Sevika/Assistant, issued in 2019 by the Additional Chief Secretary, Social Welfare Department, Government of Bihar, if a person is aggrieved in any manner, will file the application with evidence supported with the affidavit before the Child Development Project officer (C.D.P.O.), who will pass the speaking order and if concerned Child Development Project officer (C.D.P.O.) will not dispose of an application then the said application is to be forwarded to the appellate authority (the District Programme Officer), who will pass the order within a period of 45 days and that order is also appelable before the concerned Divisional Commissioner under the rivisional appeal.

In view of the above, the petitioner is directed to file a fresh application before the Child Development Project officer (C.D.P.O.), Ramgarhwa Block, East Champaran, (respondent no.6) within a period of two weeks from today and the Child Development Project officer, Block Ramgarhwa, (respondent no.6) will pass the speaking order within two months thereafter.

5. Accordingly, this writ petition stands disposed of.
