====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Sangrampur P. S. Case No. 275/2023 in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

3. As per the prosecution case, this petitioner is alleged to have kidnapped the wife of the informant.

4. Learned counsel for the petitioner submits that as a matter of fact, the petitioner and victim were Facebook friends and both fell in love and on the alleged date of occurrence, victim went to the petitioner with her own consent. The victim in her statement recorded under Section 164 Cr.P.C. has not alleged any sexual assault against the petitioner and age of the

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the statement of the victim recorded under Section 164 Cr.P.C. and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Sangrampur P. S. Case No. 275 of 2023.
