JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 Petitioner seeks bail in connection with Sone Nagar Rail P.S. Case No. 26 of 2019 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

As per FIR petitioners happen to be father-in-law and sister-in-law of the deceased and allegation is of committing dowry death and throwing the dead body in railway track. Submission of learned counsel for the petitioners is that except suspicion there is absolutely nothing against the petitioners, rather material shows that she fled away from the house and information was also given to the informant and others and later on her dead body was recovered. Moreover,

Patna High Court CR. MISC. No.78606 of 2019(3) dt.17-12-2019 2/2 petitioners are in custody for more than five months. Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. In view of above facts and circumstances, let petitioners, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Gaya, in connection with Sone Nagar Rail P.S. Case No. 26 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
