2. The petitioner seeks bail in connection with Haspura P.S. Case No. 276 of 2022 dated 14.09.2022 registered for the offences punishable under Sections 341, 323, 354B, 447 read with Section 34 of the I.P.C. in which charge sheet has been submitted for the offences punishable under Sections 323, 341, 354B read with Section 34 of the I.P.C. and Sections 8 and 12 of the POCSO Act.

3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have molested the informant when she alongwith her younger sister went for call of nature.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. The alleged occurrence took place on 11.09.2024 and the F.I.R. has been lodged on 14.09.2024 and the delay in lodging the F.I.R. has not been explained by the prosecution. It is further submitted that much prior to the present case, the father of the informant had lodged Haspura P.S. Case No. 264 of 2021 on 14.12.2021 for the offences punishable under Sections 302, 120B read with Section 34 of the I.P.C. against the relatives of the informant of the present case and the present case has been lodged by the informant with a view to pressurize on the petitioner. The petitioner is a handicapped person and to that effect a certificate has been issued by the competent authority, annexed as Annexure-2 to the present bail petition. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 17.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named

No.3104 of 2025(3) dt.30-04-2025 3/3 petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Aurangabad in connection with Haspura P.S. Case No. 276 of 2022.
