2. The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 236 of 2024 registered for the offence under Section(s) 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner, who is the husband of the deceased, is accused of killing his wife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 02.11.2024 and claims clean antecedent.

5. Learned A.P.P. for the State has vehemently

6. I have considered the submissions of the parties and have gone through the records of the case. From the materials available in the case diary it appears that the deceased received treatment during her pregnancy at various medical facilities and was finally admitted to Jawaharlal Nehru Medical College and Hospital, Bhagalpur. Dr. Oved Ali, Assistant Professor in the Department of Medicine at J.L.N.M. College and Hospital, has given a letter from which it appears that the deceased was being treated in the hospital and she died during the treatment of Bilateral Extensive Pulmonary Tuberculosis, Septicemia, and Anemia.

7. Considering the fact that the deceased died during the treatment in the Jawahar Lal Nehru Medical College and Hospital, Bhagalpur and the materials collected during investigation, this application is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jagdishpur P.S. Case No. 236 of 2024.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
