JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Muffassil P.S. Case No. 204 of 2018 registered for the offence punishable under Sections 147, 149, 386, 448, 323, 504 of the Indian Penal Code.

The allegation is of demand of ransom by the petitioner and others. Submission is that earlier criminal case was lodged by the petitioner against the informant. Considering the aforesaid fact and the fact that coaccused Devendra Yadav has been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.78285 of 2018, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days

Patna High Court Cr.Misc. No.79395 of 2018(2) dt.22-01-2019 2/2 from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Muffassil P.S. Case No. 204 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
