The petitioner has prayed for bail in connection with Gopalganj Town P.S. Case No. 523 of 2019, GR No. 1250 of 2019 registered for the offence punishable under section 414 of the Indian Penal Code and section 30(a) and 41(i) of Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 120 litres of IMFL is said to have been recovered from Alto Car wherein three accused persons were travelling. It is stated that the three apprehended persons disclosed the name of five other persons including this petitioner that they assist in crossing of the district border after taking Rs. 300/- each. The petitioner is named as

Patna High Court CR. MISC. No.81774 of 2019(2) dt.11-12-2019 2/2 one of these five accused persons, who assist the accused in crossing the district border.

Having heard learned counsel for the parties and considering the nature of allegation especially the fact that no recovery is said to have taken place from possession of the petitioner who is in custody since 15.10.2019 and has no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise, Gopalganj in connection with Gopalganj P.S.
