JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioner apprehends his arrest in connection with Panjwara P.S. Case No. 68 of 2018 registered for the offences punishable under Sections 147, 148, 149, 323, 353, 354, 504 and 506 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is that they thrashed one lady Urmila Devi on the ground and assaulted her and thereafter police personnel came and accused persons fled away.

Submission of learned counsel for the petitioner is that petitioner was not present at the place of occurrence and he has falsely been implicated in this case and he is working in Shipping Corporation of India.

Having heard both sides and in the facts and

No.78899 of 2018(2) dt.11-01-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Banka, in connection with Panjwara P.S. Case No. 68 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in investigation, otherwise his bail bond shall be cancelled.
