The petitioner is in custody since 04.05.2018 in connection with Karjain P.S. Case No. 57 of 2015 for the offence registered under Section 363, 366(A), 34 of the Indian Penal Code.

The allegation against this petitioner is that he used to write love letters to the victim girl and on the date of occurrence the present petitioner along with two others namely Amrit Kumar Sutihar and Pradip Kumar Sah had come to the house of the victim girl and taken her away. Thereafter, one of the two accused persons of this case have been granted anticipatory bail by this Court. The prayer for bail of the present petitioner was rejected on the ground that a love letter had been recovered by

Learned counsel for the petitioner, however, submits that after a couple of months of the rejection of fresh anticipatory bail application the petitioner surrendered in the court below as he came to know that the processes had been issued against him. He further submits that he shall participate in any further investigation and also during the course of the trial, so that the case reaches its logical conclusion. Having considered the aforesaid facts and circumstances of the case and the period of custody already undergone by the petitioner and that the petitioner does not carry any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur, Supaul, in connection with Karjain P.S.
