2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 379, 504, 506 and 34 of the Indian Penal Code . 3 . The prosecution case , in brief, is that on 28.10.2023 at about 07.00 AM , these petitioners along with
Patna High Court CR. MISC. No.89106 of 2024(2) dt.21-01-2025 2/3 other co-accused persons armed with deadly weapons came to the house of informant. It is further alleged that petitioner No. 2 assaulted on the head, shoulder and neck of the informant, petitioner No. 3 assaulted the brother of informant with lathi , danda and took Rs. 25,000/- from his pocket and petitioner No. 1 armed with pistol came at the place of occurrence .
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this case . As a matter of fact, on the alleged date and time of occurrence , there was quarrel between the children of both the parties in which some of them sustained injuries. Case and counter case . Injury allegedly caused by these petitioners are simple in nature . Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the nature of injury , clean antecedent of petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Khagaria in connection with Khagaria ( Muffasil ) P.S. Case No.
